By using our website, requesting a quote, scheduling service, making a payment, or otherwise
communicating with Power Pool Services, you agree to these Terms and Conditions.

If you do not agree to these Terms and Conditions, please do not use our website or services.

1. Company Information

Power Pool Services provides pool and hot tub related services, including but not limited to
pool cleaning, pool maintenance, pool openings, pool closings, inspections, water analysis,
algae removal, pool drain and clean services, equipment installation, and related services.

2. Use of Our Website

You agree to use our website only for lawful purposes and in a way that does not damage,
disable, overburden, or impair the website or interfere with any other person’s use of the
website.

You may not use our website to submit false information, attempt unauthorized access, upload
harmful code, or engage in fraudulent, abusive, or unlawful activity.

3. Estimates and Quotes

Any estimate or quote provided by Power Pool Services is based on the information available
at the time the estimate is given. Quotes may be based on details provided by the customer,
photos, site visits, pool condition, equipment condition, property access, water condition,
and other relevant factors.

Estimates are not final invoices unless specifically stated in writing. Pricing may change if
additional work is required, if the condition of the pool or equipment differs from what was
originally described, if access issues are discovered, or if additional materials, chemicals,
labor, repairs, or services are needed.

4. Scheduling and Appointments

Service appointments are subject to availability, weather conditions, technician schedules,
customer access, and other factors. Power Pool Services will make reasonable efforts to
arrive within the scheduled service window, but appointment times are not guaranteed unless
specifically agreed to in writing.

Delays may occur due to weather, road conditions, prior appointments, emergency service calls,
equipment issues, or other circumstances beyond our control.

5. Customer Responsibilities

Customers are responsible for providing safe and reasonable access to the pool, hot tub,
equipment, gates, water source, electrical panels, and any other areas necessary to perform
the requested services.

Customers agree to:

  • Provide accurate contact, billing, and service information
  • Ensure that gates, doors, locks, and access points are available when service is scheduled
  • Secure pets before service appointments
  • Notify Power Pool Services of known hazards, leaks, damaged equipment, or unsafe conditions
  • Provide access to water and electricity when needed
  • Keep the pool and surrounding area reasonably accessible
  • Make timely payments for services provided

If we are unable to perform service due to lack of access, unsafe conditions, locked gates,
unsecured pets, lack of water or electricity, or other customer-related issues, a service fee
or trip charge may still apply.

6. Pool and Equipment Conditions

Power Pool Services is not responsible for pre-existing conditions, hidden defects, improper
installation, old or failing equipment, leaks, underground plumbing issues, structural pool
issues, electrical problems, worn parts, or damage caused by lack of maintenance, improper
chemical balance, weather, freezing, storm damage, vandalism, animals, or third parties.

Service recommendations are based on visible conditions and information available at the time
of service. Additional issues may be discovered after work begins.

7. Water Chemistry and Pool Conditions

Pool water chemistry can be affected by weather, sunlight, usage, debris, equipment function,
water source, pool surface, chemicals, algae, contaminants, and customer maintenance between
visits.

Power Pool Services will make reasonable efforts to clean, maintain, and balance pool water
as part of the agreed service. However, we do not guarantee that water will remain clear,
balanced, algae-free, or swim-ready between visits, especially if there are equipment issues,
heavy usage, storms, debris, poor circulation, or other contributing factors.

8. Service Limitations

Power Pool Services performs only the services agreed to with the customer. Unless expressly
included in the estimate, quote, invoice, or written agreement, services do not include major
repairs, underground plumbing repairs, electrical work, structural repairs, pool resurfacing,
deck repairs, landscaping, or other work outside the agreed scope.

If additional work is needed, Power Pool Services may provide a separate estimate or recommend
that the customer contact a qualified specialist.

9. Payments and Billing

Customers agree to pay all charges for services, labor, materials, chemicals, parts, trip fees,
and other approved costs. Payment terms may be stated on the invoice, estimate, service
agreement, or payment portal.

Payment may be required before, during, or after service depending on the type of service,
customer history, project size, materials required, or other business considerations.

Late or unpaid invoices may result in service delays, suspension of service, late fees,
collection activity, or cancellation of future appointments.

10. Cancellations and Rescheduling

If you need to cancel or reschedule an appointment, please contact Power Pool Services as soon
as possible. We reserve the right to charge a cancellation fee, trip charge, or service fee if
an appointment is canceled with insufficient notice, if we arrive and cannot access the pool,
or if service cannot be completed due to customer-related issues.

11. Weather and Seasonal Conditions

Pool services may be affected by rain, lightning, storms, freezing temperatures, extreme heat,
poor visibility, unsafe conditions, or other weather-related issues.

Power Pool Services reserves the right to delay, reschedule, modify, or cancel service when
weather or site conditions make service unsafe or impractical.

12. Photos and Service Documentation

Power Pool Services may take photos or videos of pools, equipment, water conditions, completed
work, or service-related issues for documentation, quality control, estimates, customer
communication, training, or business records.

We will not intentionally publish identifying customer information without permission. Photos
used for marketing purposes will generally avoid showing private personal information whenever
reasonably possible.

13. Text Messages, Calls, and Emails

By providing your phone number or email address, you agree that Power Pool Services may contact
you regarding your inquiry, quote, appointment, service, invoice, payment, account, or related
customer service matter.

Communications may be made by phone call, text message, voicemail, or email. Message and data
rates may apply. You may opt out of text messages by replying STOP or request
help by replying HELP.

Consent to receive text messages is not a condition of purchasing any goods or services from
Power Pool Services.

14. Third-Party Services and Links

Our website may contain links to third-party websites, payment portals, scheduling platforms,
review platforms, social media pages, or other external resources. These third-party services
are not controlled by Power Pool Services.

We are not responsible for the content, policies, security, accuracy, or practices of third-party

18. Limitation of Liability

To the fullest extent permitted by law, Power Pool Services shall not be liable for indirect,
incidental, special, consequential, or punitive damages, including but not limited to loss of
use, loss of enjoyment, loss of profits, property damage caused by pre-existing conditions, or
damages caused by factors outside our reasonable control.

Power Pool Services’ liability for any claim related to services provided shall be limited to
the amount paid by the customer for the specific service giving rise to the claim, unless
otherwise required by law.

19. Indemnification

You agree to indemnify and hold harmless Power Pool Services, its owners, employees,
contractors, agents, and service providers from any claims, damages, losses, liabilities,
costs, or expenses arising from your use of our website, your violation of these Terms and
Conditions, inaccurate information provided by you, unsafe property conditions, lack of access,
or misuse of our services.

20. Governing Law

These Terms and Conditions are governed by the laws of the State of Wisconsin, without regard
to conflict of law principles.

Any dispute arising out of or related to these Terms and Conditions, our website, or our
services shall be handled in the appropriate courts located in Wisconsin, unless otherwise
required by law.
